These Terms and Conditions of Sale (“Terms”) govern every purchase made through the website strikebatteries.com (the “Site”), operated by:

Green World Technology Pty Ltd, an Australian company, ABN 77 616 775 001, registered office at Lev 1, 457-459 Elizabeth Street Surry Hills NSW 2010 Australia (“Strike Batteries”, “we”, “us”, or “our”).

We currently operate regional fulfilment warehouses in Australia, the United States, the United Kingdom, and Germany (“Fulfilment Centres”), and generally dispatch your order from the Fulfilment Centre serving your delivery region. The specific countries and locations we use may change from time to time as our logistics arrangements evolve; the country your order is dispatched from is shown at checkout and/or in your order/shipping confirmation.

Each warehouse generally serves customers ordering for delivery within that region only (the “Relevant Fulfilment Centre” for your order). We may change which warehouse serves a region, or use an alternative warehouse temporarily (including shipping cross-border) where reasonably necessary, such as during stock shortages.

References to “you” or “the customer” mean the person or entity purchasing products from the Site.

1. By placing an order through the Site, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other policies referenced on the Site (including shipping and returns policies), as they exist at the time you place your order.
2. You confirm that you are at least 18 years of age, or the age of legal majority in your jurisdiction, and that you have the legal capacity to enter into a binding contract.
3. These Terms apply to every order placed via the Site, regardless of the country from which you access the Site or the country to which products are shipped, subject to the region-specific clauses in Section 16 (Region-Specific Terms), which take precedence over the general body of these Terms for customers located in those regions.
4. We may update these Terms from time to time. The version in force at the time you place an order will govern that order. We recommend reviewing these Terms each time you make a purchase.

3.1 Product Range

Strike Batteries sells consumer electronics products, including (without limitation) USB-C rechargeable lithium-ion power banks and battery packs, charging cables, chargers, and other related electronic accessories, in various models and specifications as listed on the Site from time to time (each, a “Product”, collectively the “Products”). We may add new product categories to the Site over time, including future products that contain a rechargeable battery; all such products are Products for the purposes of these Terms, whether or not specifically described in this Section 3.

Where a Product contains a lithium-ion or other rechargeable battery cell (a “Battery Product”), the additional terms in this Section 3, in Section 11 (Safe Use, Misuse, and Disposal), Section 14 (Dangerous Goods — Lithium Battery Notices), and the battery take-back element of Section 15 (WEEE and Battery Take-Back Notice) apply to that Product in addition to the general terms that apply to all Products. Products that do not contain a battery (such as charging cables sold on their own) are not Battery Products and are not subject to those battery-specific clauses, but remain subject to all other provisions of these Terms, including the warranty in Section 9.

3.2 Performance Characteristics of Battery Products

In relation to Battery Products specifically, you acknowledge and accept the following inherent characteristics of lithium-ion battery technology, which are not defects and are not covered by the warranty in Section 9:

• Each Battery Product is rated for up to approximately 1,200 complete charge cycles before capacity degrades below original specification, unless a different cycle rating is stated for a specific model on the Site.
• Recharge time varies between models depending on capacity (mAh/Wh rating), the charging cable and power source used, ambient temperature, and the state of charge at which charging begins.
• Battery capacity naturally and permanently declines with age and use, independent of cycle count, due to normal electrochemical wear.
• Charging performance, runtime, and cycle life can be materially affected by factors outside our control, including ambient temperature extremes, use of third-party or non-compliant cables and chargers, deep discharge, physical damage, and storage conditions.

3.3 Product Descriptions and Images

We make reasonable efforts to ensure that descriptions, specifications, and images of Products on the Site are accurate. However, minor variations in colour, packaging, and appearance may occur, and we do not warrant that descriptions are 100% error-free.

3.4 Suitability and Compatibility

You are solely responsible for determining whether a Product is suitable for your intended use, including its compatibility with your devices, chargers, cables, vehicles, equipment, or other electronics, and, for Battery Products, compliance with any applicable transport restrictions (see Section 14). We do not warrant fitness for any particular purpose beyond the Product’s stated specifications, except as required by mandatory consumer law described in Section 9 and Section 16.

3.5 General Electronics and Electrical Safety

All Products are intended to comply with the electrical safety, EMC, and product safety standards applicable in the regions in which they are sold. You must use each Product only as intended and in accordance with any instructions or ratings provided, and must not use a Product with equipment or power sources outside its stated specifications.

1. All prices displayed on the Site are shown in the currency indicated at checkout and are subject to change without notice.
2. Prices displayed may or may not include applicable taxes (such as GST, VAT, or sales tax) and import duties, depending on your delivery destination.
3. Shipping costs are calculated at checkout based on destination, weight, and chosen shipping method, and are additional to the listed product price unless stated otherwise.
4. Payment must be made in full at the time of ordering using one of the payment methods offered on the Site. We use third-party payment processors to handle payment data; we do not store full payment card details.
5. We reserve the right to refuse or cancel any order, including after payment has been accepted, where: a Product is listed at an incorrect price; we suspect fraud or unauthorised use of a payment method; the order violates export control, sanctions, or dangerous goods shipping restrictions; or the Product is unavailable. Where an order is cancelled under this clause, you will receive a full refund.

1. Placing an order through the Site constitutes an offer by you to purchase the Product(s) in your order, subject to these Terms.
2. Our acceptance of your order, and the formation of a binding contract of sale, occurs only when we send you a shipping confirmation (or equivalent dispatch notice).
3. We may, at our discretion, decline to accept any order for any lawful reason prior to dispatch.

6.1 Dispatch and Delivery Estimates

Products are shipped from the Relevant Fulfilment Centre serving your delivery region. Estimated delivery times shown on the Site or at checkout are estimates only and are not guaranteed.

6.2 Passing of Risk

Risk of loss, damage, or destruction of a Product passes to you, the customer, upon dispatch from the Relevant Fulfilment Centre to the carrier, to the maximum extent permitted by law. Where the mandatory consumer law of your region requires risk to remain with us until delivery, that mandatory rule will apply instead — see Section 16 for region-specific variations.

1. You are responsible for providing a complete, accurate delivery address.
2. If a Product is lost or damaged in transit after risk has passed to you, your recourse is against the carrier or your shipping insurance (if any).
3. Title to the Products does not pass to you until we have received full payment.

Because we generally ship your order from the warehouse serving your own delivery region, most orders are domestic shipments and are not subject to import duties. This Section 7 applies only where your order is, exceptionally, shipped from a Fulfilment Centre outside your country.

1. Where your order does cross an international border, it may be subject to import duties, customs clearance fees, and local taxes. These charges are your sole responsibility.
2. We have no control over these charges and cannot predict their amount.
3. You are responsible for compliance with all laws and regulations of the destination country.
4. If you refuse to pay applicable customs duties or taxes, resulting in the Product being returned to us or destroyed, no refund will be made of the original shipping costs.

8.1 General Approach

Except where a longer mandatory period applies under Section 16 for your region, and except for faulty Products (covered under Section 9), all sales are final once the applicable mandatory cancellation/withdrawal window (if any) has expired. We do not offer a discretionary change-of-mind return policy beyond the legal minimums set out in Section 16 for your region.

8.2 Condition of Returned Products

Where you are entitled to and exercise a right to cancel or return a Product, the Product must be returned in line with the specific conditions set out for your region in Section 16.

8.3 Lithium Battery Returns — Shipping Restrictions

Returned lithium-ion batteries are dangerous goods and may be subject to carrier restrictions. You must not ship a damaged, swollen, leaking, or otherwise compromised battery by post or courier under any circumstances — contact us first for safe disposal/return guidance.

8.4 Return Shipping Costs

Except where a Product is faulty or mandatory law in your region requires otherwise, return shipping costs are your responsibility.

9.1 Warranty Term

Each Product is covered by a 12-month (1-year) limited warranty against manufacturing defects, running from the date of delivery to the original purchaser.

9.2 What Is Covered

The warranty covers defects in materials or workmanship that exist at the time of manufacture and cause the Product to fail to perform as specified under normal use, including:

• Failure of the Product to power on, charge, hold a charge, or otherwise function as specified, where not caused by misuse;
• Failure of internal components, wiring, or connectors present at the point of sale;
• For Battery Products: premature capacity loss substantially below the stated cycle-life specification.

9.3 What Is Not Covered

The warranty does not cover issues arising from:

• Normal wear and tear, including gradual battery capacity decline;
• Use beyond the rated charge-cycle lifespan;
• Physical damage, including drops, crushing, punctures, or exposure to liquid, fire, or extreme temperatures;
• Use of incompatible, damaged, or non-compliant third-party cables, chargers, or power sources;
• Unauthorised modification, disassembly, or repair attempts;
• Misuse, abuse, neglect, accident;
• Cosmetic damage that does not affect function;
• Products purchased from unauthorised resellers or second-hand;
• Any Product where proof of purchase cannot be provided.

9.4 How the Warranty Is Honoured

Products are manufactured for us by one or more third-party manufacturers, principally based in China. Where a warranty claim is accepted as a genuine manufacturing defect, the claim will be assessed, processed, and resolved in accordance with the relevant manufacturer’s standard warranty policy and procedures.

9.5 Making a Claim

1. To make a warranty claim, contact us with your order number, a description of the fault, and (if requested) photographic or video evidence of the fault.
2. We may require you to ship the Product to a nominated address for inspection before a claim is approved.
3. We are not responsible for Products lost in transit to us during a warranty claim where you have not used a tracked shipping method.

To the maximum extent permitted by law, and subject always to the non-excludable rights described in Section 16 for your region:

• We exclude all liability for indirect, incidental, special, or consequential loss or damage of any kind.
• Our total aggregate liability to you in connection with any order is limited to the total amount you paid for the relevant Product(s).
• Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence.
• You assume all risk and responsibility for the selection, use, storage, transport, and disposal of the Product.

1. You must use, store, charge, and dispose of each Product strictly in accordance with any instructions provided with it and any applicable local laws.
2. In relation to Battery Products: lithium-ion batteries can pose a fire or chemical burn risk if damaged, charged with incompatible equipment, exposed to extreme heat, punctured, or disposed of incorrectly. You must not disassemble, puncture, crush, or expose a Battery Product to fire or temperatures outside its rated range.
3. In relation to cables and other non-battery electronic accessories: you must not use a Product with a frayed, cut, or otherwise damaged cord or housing.
4. You are responsible for disposing of each Product at end-of-life through an appropriate electronic waste or battery recycling collection point. See Section 15 for EU/UK-specific WEEE and battery take-back information.
5. We accept no liability for any loss, damage, injury, or death arising from your failure to follow this Section 11, except to the extent caused by a manufacturing defect covered under Section 9.

All content on the Site, including text, graphics, logos, product images, and software, is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, strikes, pandemics, governmental action, customs delays, carrier disruption, or shortage of materials.

1. Battery Products contain lithium-ion cells and are classified as dangerous goods (UN3480 or UN3481) for the purposes of international transport regulations, including IATA Dangerous Goods Regulations and the ADR.
2. We package and ship Battery Products in accordance with applicable dangerous goods regulations. You must not attempt to re-ship, re-import, or carry a Battery Product other than in accordance with the rules of the relevant transport provider and applicable law.
3. If you are a business customer purchasing Battery Products for resale or distribution, you are independently responsible for ensuring your own compliance with all applicable dangerous goods, labelling, and transport laws.

If you are located in the European Union or United Kingdom:

• The crossed-out wheelie bin symbol on a Product or its packaging indicates that the Product must not be disposed of with unsorted household waste.
• You can return waste electrical equipment and waste batteries free of charge to designated collection points.
• Correct disposal helps prevent potential environmental and health impacts and supports the recovery of materials for reuse.

16.1 Australia

1. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law (“ACL”).
2. Under the ACL, our Products come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.
3. The warranty in Section 9 is provided in addition to these statutory consumer guarantees.
4. For the purposes of the ACL, our contact details are as set out in Section 1.
5. For Australian customers, risk passes on delivery to you, notwithstanding Section 6.2, to the extent required by the ACL.

16.2 United States

1. Products sold to customers in the United States are sold with an express limited warranty as set out in Section 9, in addition to any implied warranties that may apply under the law of your state.
2. Some states do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages, so the limitations in Sections 9 and 10 may not apply to you in full.
3. This warranty gives you specific legal rights. To the extent required by the Magnuson-Moss Warranty Act, this is designated a “limited warranty”.
4. Sales and use tax will be calculated and collected at checkout in accordance with applicable state and local law.
5. Any dispute arising under these Terms that is not resolved through good-faith negotiation may be subject to arbitration or small-claims proceedings as further detailed in Section 17.

16.3 United Kingdom

1. If you are a consumer in the UK, the Consumer Rights Act 2015 gives you certain legal rights in relation to the Products. Nothing in these Terms affects those legal rights.
2. You have a legal right to cancel your order within 14 days of receiving the Products without giving any reason (the “cooling-off period”).
3. If you cancel, you must return the Product within 14 days. We will refund the price paid within 14 days of receiving the returned Product.
4. We may make a deduction from the refund for loss in value resulting from unnecessary handling.
5. The 14-day cooling-off right does not apply to Products that have been unsealed after delivery where they are not suitable for return due to health or hygiene reasons.
6. Risk in the Products passes to you when the Products are delivered to you. Section 6.2 does not apply to UK consumers.
7. This warranty is in addition to your statutory rights under the Consumer Rights Act 2015.

16.4 European Union

1. If you are a consumer in the EU, the EU Sale of Goods Directive (2019/771) applies, including a minimum 2-year legal guarantee of conformity.
2. Under the legal guarantee of conformity, if a Product does not conform, you are entitled to repair, replacement, a proportionate price reduction, or contract termination and refund.
3. You have the right to withdraw from this contract within 14 days without giving any reason, in accordance with the Consumer Rights Directive (2011/83/EU).
4. To exercise the right of withdrawal, you must inform us of your decision by a clear statement before the withdrawal period expires.
5. If you withdraw, we will reimburse all payments received from you within 14 days.
6. You must send back the Products within 14 days of communicating your withdrawal. You will bear the direct cost of returning the Products unless the Product is non-conforming.
7. Risk in the Products passes to you only upon delivery to you. Section 6.2 does not apply to EU consumers.
8. Where the Site offers an EU Online Dispute Resolution (ODR) link, you may also refer disputes to https://ec.europa.eu/consumers/odr.

1. Subject to Section 17.2, these Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.
2. Where you are a consumer resident in the United Kingdom, the European Union, or a US state, and mandatory consumer protection law would otherwise apply, that mandatory law and those rights apply.
3. Before initiating formal proceedings, we encourage you to contact us so that we can attempt to resolve any dispute informally and promptly.

1. Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be deemed modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
2. No Waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
3. Assignment: We may assign or transfer our rights and obligations under these Terms without your consent, provided this does not reduce your rights. You may not assign your rights without our prior written consent.
4. Entire Agreement: These Terms, together with our Privacy Policy and any other policy expressly referenced, constitute the entire agreement between you and us in relation to your purchase.
5. Language: These Terms are provided in English. Any translation is for convenience only, and the English version prevails except where local mandatory law requires a local-language version to govern.
